How to Comm

Step 1:
Review the site & terms of conditions carefully. If everything looks good, you can proceed to fill out the commission form ( VGen or Google Doc ).

Step 2:
Within 1 - 5 business days, I will check over the form and see that everything is filled out and you provided all references and information needed. I will respond with a quote pricing on your specific needs along with confirmation.Payment can be done via VGen ( +8% fee ), Paypal ( +6% fee ), or Ko-Fi.

Step 3:
The drawing process begins! This can take a week to 2 months depending on how busy I am. The process of approval and editing awaits. ~ ✧･ﾟThe first approval stage will be sketching, visualing your ideas and will appear rough. You will not see clear lines or quality image, just to give you the idea of the vision. This is the key stage for any major revisions!!✦✦✦ After sketch is complete and approved, only MINOR REVISIONS will be possible ( refer to tos ) ✦✦✦

Step 4:
Lining and coloring. After the sketch is approved, I will begin polishing and lining the final product. At this stage you will be able to see how the result will look like and can make any minor decorative / color edits before I render and finish up. For example, you can edit colours & add small details.

Step 5:
I will finish the rest ! Once the final result is approved, I will send you the files in the required formats and sizes. That completes our commission journey ~Every commission is individual and a unique experience, but I hope this gives an idea of what to generally expect when we work together. How do I check my commission progress?
Updates will be given on each progress step as we go along, but if you would like to you can follow along over on my trello where I post updates on progress for every order. Thank you for your patience!

What is the difference between 336px and 500px for emotes?
The size depends on what you would like to use it for.

500px canvas is $10 additional per emote. Fees for merchandise such as stickers is twice the original commission price +20%. For example, one emote at 500px would be $35+10=$45 usd. If you want to sell the design/emote as a sticker or keychain etc etc, it would be $45x2=$90 + 20% = $108usd.

Terms of Service

✦ Before starting a project, we need to make sure we are on the same page so there aren't misunderstandings and to protect against fraud, so please take some time to read through these terms! Thank you. ✦This Terms of Service Agreement ("Agreement") is entered into between the Artist and the Client for the commission of an artwork ("Work"). By commissioning the Artist, the Client agrees to the following terms:

✧･ﾟ 1. Engagement

✦ The client will have a list or google doc with all of the commission info and any type of references or details they’d like to include
✦ Waitlist Applications before comms open are not allowed unless announced
✦ Commissions will be accepted via Google Forms or VGEN and continued via Twitter DMs or Email as checked upon in the form✦ The Artist reserves the right to refuse projects or requests based on content, subject, or other reasons
✦ The Artist holds the right to draw personal work whilst doing client commissions
✦ Updates on each progress step will be given ( how to comm for details on these steps; ask for updates if you like ! )✦ Artist defines scope of work, features, price, deliverables and other details for the project in a proposal in a format according to Artist discretion which may include private message through Discord or Twitter, VGen platform, Google document, or email. The details set forth by the Artist shall be agreed upon by the Client before work begins
✦ Client not responding 3 days of agreeing on the commission will risk cancelling their application✦ Artist strives to perform to the best of their ability in good faith and warrants Work is 100% original according to Artist’s best knowledge
✦ Artist may use commercially licensed, copyright-free and/or educational materials, assets and/or tools

✧･ﾟ 2. Content Restrictions

✦ Artist will not create content that is explicit, offensive, or inappropriate.

✦ Please do not disclose any personal information found in the transaction process or legal action will be taken
✦ The Artist and Client acknowledges that information and materials that are provided to either party ( including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information ) outside of the development of Work, that will not be visible to the public, shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information
✦ Let the Artist know if the finished commission isn't to be posted on social media/public spaces before hand. Announce that the commission is to be private

✧･ﾟ 4. Payments & Fees

✦ All prices are in USD $
✦ Client agrees to send payments via Paypal invoice ( 6% fee ), VGen ( +8% fee ), OR ko-fi only. Additional fees will be included in the base commission fee. Paypal or other service fees will be added to that base commission fee and calculated to create the final invoice
✦ Invoice will be sent to the commissioner after agreement between the artist and commissioner before the sketch
✦ Invoices must be paid within 48 hours, or the project may be cancelled✦ Half payment available for orders valuing over $200 ( second half after final sketch approval )
✦ Price of commission may vary or change depending on complexity. Starting price range are stated in each commission info graphic
✦ Client agrees that they will not issue chargebacks and the refund policy will be followed✦ The client will be added to the queue only after full or half payment has been sent ( 50% of downpayment for higher value projects )✦ Ko-fi YCH: Payment is done through purchase on Ko-fi Commissions/Shop and will already have the additional fee from paypal attached
✦ vgen: Payment is done through purchase on vgen

✦✦✦ Clients do not need to have extra rights to use emotes, badges, & panels on Twitch, Discord etc., since this is direct purpose of emotes and badges and does not imply their sale. Prices on infographic INCLUDE commercial fees ✦✦✦
✦ All other commissioned works intended only for personal non-commercial use & are not listed with commercial fees

･ﾟ✧ Revisions are allowed once per item shown to the client during the sketch process. After the sketch is approved by the client, only minor revisions are allowed. After line-art/flat colors are approved, no revisions are allowed.
✦ Revisions may affect progress & timeline✦ Additional charges for major/excessive revisions may be required. Refer to the chart above for what types of revisions incur possible charge
✦ ✦ Any additional charges will be invoiced separately as the original price will be already paid prior to the start of the commission. ✦

✧･ﾟ 5. Cancellation & Refunds

･ﾟ✧ 100% refund possible when the Artist personally cancels the order ( e.g.: Get into accident/hospital stay/emergency) or BEFORE the commission starts.
･ﾟ✧ 40% refund possible when the commission is still in the sketching process
･ﾟ✧ NO REFUNDS after the artist post-sketch process✦ Major design changes will be considered a new commission and risk charge of full price✦ Before cancelling the order/commission, please contact the artist IMMEDIATELY prior to payment

✧･ﾟ 6. Timeline & Process

✦ After the artist received payment, the requested project will begin. Work completion requires 7 business days minimum, and may take up to 2 business months depending on each project ( business days M - Th )
✦ Rush orders are available and are 80% additional fee of the total commission price. Rush orders are delivered in 1-3 business days and require the client to respond to approval stages promptly to ensure on time delivery. If the client fails to reply they risk not having their finished product delivered within the 1-3 business day time frame.
✦ Timeline depends on commission type, complexity, workload, and orders ahead in queue. The client should plan launches & streams accordingly✦ The artist will provide progress updates in stages & will provide a rough ETA when requested
- After approval of the final sketch, I will update you at the lined/colored design. Check revision charge chart for details on when you can revise after sketch phase
✦ If there are any delays & adjustments to the timeline, the artist will inform the client
✦ Clients have the right to request refunds 3 months after deadlines according to if Work has not been delivered and there was no agreed upon amendment to the timeline✦ Final deliverables are provided by the artist using the VGen Platform, email, Google Drive, or other similar tools are applicable. Any files hosted by the artist will be available for the client to download for 12 months ( 1 year )
✦ All deliverables are digital and there are no physically shipped goods to receive

✧･ﾟ 7. Communication

✦ Ongoing communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more
✦ Communication channels may include Discord or Twitter private messages, Trello, or others according to Artist discretion✦ Artist response time may vary, up to one work week in order to provide better or more concrete updates
✦ The Artist and Client agree to discuss relevant matters concerning the project. Both parties have the right to decline other topics of discussion

✧･ﾟ 8. Copyright Policy

✦ Credits must be given to the artist ( @starricow on Twitter/IG/vgen, @starricowdesigns on twitch )
✦ Client must not claim Work as their own and must credit Artist using their social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on✦ The Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios, public broadcast channels ( i.e. Twitch ) and more
✦ The Artist may use rejected work in progress and versions for other projects according to their discretion, under the condition that it does not infringe the Client's intellectual property rights and ownership of their likeness, character design, branding, identity design or any such trademarks✦ Commissioner is not allowed to reproduce or alter commissioned piece to resell for profit
✦ Commissioner may re-post and use the commission without majorly editing the artwork ( animation OK , layer file extra charge )
✦ If commisioner would like to buy rights to the commissioned art, extra 40% charges of the total commission will incur. If commisioner would like to buy retail rights to the commissioned art, you must pay twice original price + 20% additional✦ Usage of Work for AI (artificial intelligence ) tools, platforms or programs; ML ( machine learning ) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited✦ Personal use means: display on social media accounts for promotional purposes with no direct monetization, such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels
✦ Commercial rights may differ for each commission type. Commercial broadcast rights means usage of Work on streams, videos, advertisements and other content, or any similar monetized instances; commercial distribution rights means selling or reselling Work to another party, as a part of any product or merchandising, or on another platform

✧･ﾟ 9. Indemnification

✦ Client indemnifies Artist against claims, losses, damages, and expenses related to Work usage by the Client, breach by the Client of the Agreement, or third-party claims✦ If Client's rights and the terms of this agreement are violated or the Work is not delivered as agreed, due to Artist negligence, Artist will work to remedy the situation first according to the terms aforementioned and otherwise to the satisfaction of the Client

✦ Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf
✦ Client warrants that they have the authority to enter this agreement, be the point of contact and is solely responsible for decisions and approval during the process.
